"The Services"
The Duet business cloud applications described on this website and any other software, services or websites provided by DMpro now or in the future which link to Duet, such as mobile apps and Application Programming Interfaces (API).
"The Data"
The data that is input or uploaded by You into our websites or The Services.
These Terms & Conditions apply if you accept them electronically (e.g. by ticking "I agree") or install, access or use any The Services. If you do not agree with these Terms & Conditions then you may not use The Services.
We may offer access to our Services on an free trial basis. If you continue using the Services after the free trial period ends, you will start to be billed for usage in accordance with clause 3b.
Services offered on a "Pay As You Go" basis will be invoiced at the end of each calendar month in accordance with the fees set out in the Pricing section of our website.
Services offered on a "Prepayment" or "Subscription" basis will be invoiced at the start of the agreed prepayment period. Any usage that is above or outside the agreed prepaid plan will be invoiced on a "Pay As You Go" basis in accordance with the fees set out in the Pricing section of our website.
4.1 The Services are protected by copyright and other intellectual property laws. You are only granted the right to use the Services and only for the purposes described by DMpro.
4.2 You agree not to use, nor permit any third party to use, the Services or content in a manner that violates any applicable law, regulation or this Agreement.
Your use of the Service may be subject to limitations if, in our opinion, your level of usage is so unusually high that it is likely to have a detrimental affect on our capacity to offer a fair service to other customers. In such a scenario we will contact you to advise you of the limitations and discuss possible solutions.
Acceptance of these Terms & Condition implies acceptance of our Privacy Policy.
Consumer Guarantees
7b. You warrant and represent that You are acquiring the right to access and use the Services for the purposes of a business and that, to the maximum extent permitted by applicable law, any statutory consumer guarantees or legislation intended to protect non-business consumers in any jurisdiction does not apply to the supply of the Services, the Website or these Terms.
We reserve the right to change this Agreement at any time, and the changes will be effective when posted on our website or when we notify you by other means. We may also change or discontinue the Services, in whole or in part. Your continued use of the Services indicates your agreement to the changes.
Services offered on a "Pay As You Go" basis are invoiced based on your usage. If you stop using the Services, then you will no longer incur any charges. You must notify us in writing if you wish to suspend or terminate your account.
Services offered on a "Prepayment" or "Subscription" basis are invoiced at the start of the agreed prepayment period. You must notify us in writing if you wish to terminate your agreement. Once we have received your notice of termination then we will terminate your account at the end of the current prepaid period. We will not provide a refund for any partial prepaid period.
All copyright, trade marks and other intellectual property rights in The Services, the websites and documentation are either owned by or licensed to DMPro, and shall not be transferred to You.
All copyright, trade marks and other intellectual property rights in The Data belong to You and shall not be transferred to DMpro.
